XORELIPlease read this agreement before installing. By installing or using MasterMind ("the Software") you accept these terms. If you do not accept them, do not install the Software.
1. Licence
1.1 Y. Aksu, Master Mariner, the author and owner of MasterMind ("the Licensor"), grants you a non-exclusive, non-transferable licence to install and use the Software on the number of computers stated in your licence, for the period stated in your licence, for the internal business of the licensee (ship, company or person named in the licence).
1.2 A free trial of 15 days is allowed on one computer for evaluation only.
1.3 The licence is activated per computer. Moving the licence to another computer requires deactivation of the old computer.
1.4 Updates, rule / reference data and notices are provided while the licence is valid. After the licence ends the Software stops working after a short grace period; your own data stays on your computer and can be exported.
2. Restrictions
You may not:
(a) copy, sell, rent, lend, share, publish or distribute the Software, licence keys or activation codes;
(b) decompile, disassemble, decrypt, reverse engineer or modify the Software, or try to extract its program code, data or built-in reference material, except where the law expressly allows this;
(c) remove or bypass the licence check, the encryption or any copyright notice;
(d) use the Software to build a competing product.
The Software contains identifying marks so that unauthorised copies can be traced.
3. Ownership
The Software, its design, texts, templates, rule summaries and data compilations are protected by copyright and remain the property of the Licensor. Third-party components are used under their own licences (e.g. Astronomy Engine – MIT licence, PDF.js – Apache 2.0, Tesseract.js – Apache 2.0, Electron – MIT licence); their notices are included in the Software.
4. Your Data
Your records, letters, voyage files and settings are stored on your computer, encrypted with your password. The Licensor has no access to them. The licence check sends only the licence key, a computer code (not personal data) and the program version. AI functions, if you enable them with your own API key, send the text you choose to the AI provider under that provider's terms.
5. Important – The Master Remains Responsible
The Software is a decision-support tool. Results (letters, calculations, rule checks, distances, positions, celestial fixes) must be checked against the ship's documents, the charter party, ECDIS / official charts and publications and the applicable regulations (MARPOL, SOLAS, flag and port State rules). Rules and data can change after a version is released. The Software is not a substitute for GNSS / ECDIS, official nautical publications, legal advice or the judgement of the Master.
6. No Warranty
The Software is provided "as is". To the extent permitted by law, the Licensor gives no warranty that it is free of errors or fit for a particular purpose.
7. Limitation Of Liability
To the extent permitted by law, the Licensor is not liable for indirect or consequential loss (including loss of hire, demurrage, fines, detention, claims or loss of data) arising from the use of the Software. The Licensor's total liability is limited to the licence fee paid for the current licence period.
8. Termination
The licence ends automatically if you breach these terms. The Licensor may revoke a licence key that has been shared, sold or used in breach of this agreement.
9. Law
This agreement is governed by the laws of the Republic of Türkiye. The courts of Istanbul have jurisdiction.
